La recaudación tributaria es una tarea fundamental para el financiamiento del Estado, pero cuando los contribuyentes no con cumplen con dicha obligación el Servicio de Rentas Internas se ve forzado a iniciar el proceso de ejecución coactiva, es en esa instancia donde la falta de claridad y consistencia de la normativa tributaria se transforma en un problema tanto para el contribuyente como para la administración, pues queda a discrecionalidad de esta última actuaciones fundamentales como la disposición de medidas cautelares, mismas (...) que pueden afectar derechos constitucionales del usuario. El estudio tiene como propósito primordial evaluar la efectividad de los procesos de ejecución coactiva sustanciados por el SRI en la protección del derecho a la propiedad y seguridad jurídica, para lo cual se aplicó el método mixto, a través de la implementación de encuestas a cien usuarios del sistema tributarios y entrevistas semiestructuradas a profesionales del Derecho. Tras el procesamiento de los datos se evidencia una postura de rechazo por parte de la población ante la actuación de los funcionarios ejecutores del proceso coactivo, pues la disposición desproporcionada de medidas como la retención o la prohibición de enajenar afectan significativamente sus derechos. Como conclusión se determina que la falta de claridad y armonización de la norma tributaria posibilita que los funcionarios públicos quebranten el principio de buena fe y rebasen con sus actuaciones los límites del derecho de propiedad y seguridad jurídica de los afiliados al sistema tributario. El estudio analiza un curso Blended Learning para identificar patrones de interacción didáctica que favorecen la construcción del conocimiento y por ende, del aprendizaje. La investigación muestra en la transición hacia la virtualidad desde la presencialidad, una apropiación gradual del aprendizaje y una orientación hacia la autonomía. Las transiciones indican mayor elaboración de contenidos significativos en lo virtual, señalando una relación entre interacción virtual intensificada, aprendizaje y menor dependencia docente. El análisis de la práctica educativa en Blended Learning promueve autonomía, (...) logros y participación mediante colaboraciones entre pares y mayor interacción social, conduciendo a resultados notables. La investigación formativa es un método educativo que involucra a los sujetos en su propia formación en investigación. Este estudio explora el desarrollo y perspectivas de la investigación formativa en universidades peruanas a través del análisis de informes de tesis de posgrado. Utilizando la cartografía conceptual como método de análisis, se identifican conceptos clave, categorías y diferencias conceptuales, revelando el panorama de la investigación formativa y sus desafíos en la universidad peruana. This study offers a proposal about which competencies should be fostered in organizations to promote a culture in favor of sustainability in line with Pope Francis' encyclical letter Laudato Si. As a result, seven main competencies are proposed, with their interpretation in the light of the encyclical letter, and some suggestions on how to implement them in organizations are presented. The competencies are systemic vision, critical thinking, capacity for dialog, inclusion, proper use of goods, creativity, and spirituality. In addition, the (...) study offers a discussion of the relevance of these competencies in today's business context. This study offers a novelty with respect to other theoretical proposals on competencies for sustainability since it includes competencies that require an authentic concern for other people and for a vision of the human being open to transcendence, thus breaking with instrumentalism and technocratic paradigm that underlies other proposals. In this way, it also offers a new key to interpreting the integral ecology proposed by Pope Francis, which goes beyond other approaches to sustainability in that it includes not only the person–nature relationship but also the person–person and person–transcendence or person–God relationships. The conclusions of this theoretical research can be especially useful for those who intend to promote a culture of sustainability inspired by the Catholic Social Teaching, also making use of the knowledge and good practices of competency-based management. Este trabajo busca presentar el debate alrededor de la materialidad del cuerpo en dos grandes teorías feministas, a saber, las teorías feministas de la diferencia sexual y la teoría feminista alrededor del género. En ese sentido, mi interés es mostrar cómo, desde una distinta aproximación al concepto de cuerpo, se articulan unas diferencias para reivindicar las luchas feministas. Quisiera en particular acercarme a las pensadoras Judith Butler y Rosi Braidotti, que tienen una articulación distinta del sujeto-cuerpo del feminismo y el (...) lugar que este debe ocupar en las transformaciones sociales y políticas. In a large Colombian teaching hospital, a fifty-five-year-old woman complaining of stomach pain is examined by a foreign-exchange medical student from the United States. Speaking in Spanish, the student elicits a medical history that suggests a possible recurrence of gallstones, but nothing further. Upon discussing the patient's case in private with the attending physician, the student is shocked to learn that the patient is suffering from terminal, metastatic gastric cancer but is unaware of her diagnosis. The attending physician explains that (...) the patient's husband instructed the health care providers not to tell the patient what her diagnosis is. The medical student feels uncomfortable withholding the diagnosis from the patient. The thought of disclosure feels equally uncomfortable, however, as it would mean contradicting the instructions of the attending physician at the host hospital as well as violating what the student suspects, but is not sure, may be acceptable medical practice in Colombia. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In summary, we obtained cross-cultural evidence for the distinctiveness of unfounded conspiracy and health beliefs about COVID-19 in terms of their structure and correlates. (shrink)

Abstract:Facial transplantation is emerging as a therapeutic option for self-inflicted gunshot wounds. The self-inflicted nature of this injury raises questions about the appropriate role of self-harm in determining patient eligibility. Potential candidates for facial transplantation undergo extensive psychosocial screening. The presence of a self-inflicted gunshot wound warrants special attention to ensure that a patient is prepared to undergo a demanding procedure that poses significant risk, as well as stringent lifelong management. Herein, we explore the ethics of considering mechanism of injury (...) in the patient selection process, referring to the precedent set forth in solid organ transplantation. We also consider the available evidence regarding outcomes of individuals transplanted for self-inflicted mechanisms of injury in both solid organ and facial transplantation. We conclude that while the presence of a self-inflicted gunshot wound is significant in the overall evaluation of the candidate, it does not on its own warrant exclusion from consideration for a facial transplantation. El pensamiento está relacionado con un modo de ser. La forma de pensar que privilegia la ciencia pasa por alto el contexto, pareciera que eso es irrelevante, pues se cree que el pensamiento está alejado de la realidad natural e histórica. Sin embargo, el cómo se piensa incide en la relación que los sujetos mantienen con las cosas, los objetos, las situaciones y también entre sí. La razón moderna en cuanto científica y dominante, no sólo ha permitido el desarrollo técnico, (...) también objetualiza lo diferente a sí misma, ese es el punto desde el cual filosofa Esther Díaz, dicho filosofar es recuperado e interpretado en este documento. La crítica a la ciencia en cuanto dominante y unívoca no invalida a los conocimientos dados a partir de ella, no se aboga por una clausura de la razón, sino que se confía en ella, siempre y cuando, sea capaz de abrirse a las distintas perspectivas. La apertura repercutiría a nivel político, en el sentido de que los sujetos se curarían del delirio de la dominación. Assessing physical fitness has emerged as a proxy of the health status of children and adolescents and therefore as relevant from a public health point of view. DAFIS is a project included in Plan Galicia Saudable of the regional government of Galicia. DAFIS consists of an on-line software devoted to record the results of a standard physical fitness protocol carried out as a part of the physical education curriculum. The aims of this study were: to obtain normative values of physical (...) fitness of the Galician school population evaluated in the DAFIS project, and to identify a reduced number of components and tests able to capture a significant amount of the variability in the physical fitness of children and adolescents. From an initial sample of 27784 records, 15287 cases were considered after filtering. Generalized Additive Models for Location, Scale and Shape were used for obtaining percentile curves and tables for each sex. Furthermore, a principal components analysis was performed, selecting the number of components by applying the Kaiser’s rule and selecting a subset of variables considering the correlation between each variable and the components. Percentile curves and normative values are reported for each test and sex. Physical fitness was better in boys than in girls throughout age groups, except for flexibility that was consistently higher in girls. Two main components were detected throughout age groups: the first one representing body composition and partially cardiorespiratory fitness and the second one muscular fitness. For boys and girls, waist to height ratio had the highest correlations with the first component in four out of six age groups. The highest correlation with the second component, was most frequently observed for the handgrip test both in boys and girls. This study provides evidence about the utility of school community actions like DAFIS aimed to track the health-related fitness of children and adolescents. The results suggest that fat mass distribution and muscular performance concentrate a high proportion physical fitness variance. (shrink)

RESUMEN Una vez que el foco de la reflexión pasa de las teorías ideales a la aplicación de la justicia social, centrada en las instituciones de las sociedades democráticas, se requiere prestar especial atención a los estilos de vida. Estos tienen una alta incidencia en cómo la justicia es realizada y afectan tanto a la desigualdad económica como a la disponibilidad de los recursos naturales. En nuestras sociedades es posible establecer restricciones a los estilos de vida, especialmente en aquellos casos (...) en que, por el efecto de algunas dinámicas sociales, aquellos se desacoplan de las concepciones del bien. Se defiende que, en tales casos, la base normativa que permite exigir el respeto a los estilos de vida se disuelve y por ello es posible justificar su restricción. ABSTRACT Now that the focus of reflection has shifted from ideal theories to the application of social justice, centered on the institutions of democratic societies, it is necessary to pay special attention to lifestyles, since they not only influence the realization of justice, but also have an effect on economic inequality and the availability of natural resources. In our societies, it is possible to place restrictions on lifestyles, especially in those cases in which, influenced by certain social dynamics, they disengage from conceptions of the good. The article argues that, in those cases, the normative base grounding the demand that lifestyles be respected is dissolved, thus justifying their restriction. (shrink)

Adding a transparent truth predicate to a language completely governed by classical logic is not possible. The trouble, as is well-known, comes from paradoxes such as the Liar and Curry. Recently, Cobreros, Egré, Ripley and van Rooij have put forward an approach based on a non-transitive notion of consequence which is suitable to deal with semantic paradoxes while having a transparent truth predicate together with classical logic. Nevertheless, there are some interesting issues concerning the set of metainferences validated by this (...) logic. In this paper, we show that this logic, once it is adequately understood, is weaker than classical logic. Moreover, the logic is in a way similar to the paraconsistent logic LP. (shrink)

In some recent articles, Cobreros, Egré, Ripley, & van Rooij have defended the idea that abandoning transitivity may lead to a solution to the trouble caused by semantic paradoxes. For that purpose, they develop the Strict-Tolerant approach, which leads them to entertain a nontransitive theory of truth, where the structural rule of Cut is not generally valid. However, that Cut fails in general in the target theory of truth does not mean that there are not certain safe instances of Cut (...) involving semantic notions. In this article we intend to meet the challenge of answering how to regain all the safe instances of Cut, in the language of the theory, making essential use of a unary recovery operator. To fulfill this goal, we will work within the so-called Goodship Project, which suggests that in order to have nontrivial naïve theories it is sufficient to formulate the corresponding self-referential sentences with suitable biconditionals. Nevertheless, a secondary aim of this article is to propose a novel way to carry this project out, showing that the biconditionals in question can be totally classical. In the context of this article, these biconditionals will be essentially used in expressing the self-referential sentences and, thus, as a collateral result of our work we will prove that none of the recoveries expected of the target theory can be nontrivially achieved if self-reference is expressed through identities. When discussing Logical Pluralism several critics argue that such an open-minded position is untenable. The key to this conclusion is that, given a number of widely accepted assumptions, the pluralist view collapses into Logical Monism. In this paper we show that the arguments usually employed to arrive at this conclusion do not work. The main reason for this is the existence of certain substructural logics which have the same set of valid inferences as Classical Logic—although they are, in a clear (...) sense, non-identical to it. We argue that this phenomenon can be generalized, given the existence of logics which coincide with Classical Logic regarding a number of metainferential levels—although they are, again, clearly different systems. We claim this highlights the need to arrive at a more refined version of the Collapse Argument, which we discuss at the end of the paper. (shrink)

The concept of _substructural logic_ was originally introduced in relation to limitations of Gentzen’s structural rules of Contraction, Weakening and Exchange. Recent years have witnessed the development of substructural logics also challenging the Tarskian properties of Reflexivity and Transitivity of logical consequence. In this introduction we explain this recent development and two aspects in which it leads to a reassessment of the bounds of classical logic. On the one hand, standard ways of defining the notion of logical consequence in classical (...) logic naturally induce substructural logics when admitting more than two truth values; on the other hand, these substructural logics give rise to hierarchies of _metainferences_ that can be used to approximate classical logic at different levels. Transhumanist thought on overpopulation usually invokes the welfare of present human beings and the control over future generation, thus minimizing the need and meaning of new births. Here we devise a framework for a more thorough screening of the relevant literature, to have a better appreciation of the issue of natality. We follow the lead of Hannah Arendt and Brent Waters in this respect. With three overlapping categories of words, headed by “natality,” “birth,” and “intergenerations,” a large sample of books (...) on transhumanism is scrutinized, showing the lack of sustained reflection on the issue. After this preliminary scrutiny, a possible defense of natality in face of modern and transhumanist thought is marshaled, evoking a number of desirable human traits. One specific issue, the impact of modern values on natality, is further explored, reiterating that concerns about overpopulation and enhanced humans should keep in sight the natural cycle of birth and death. This essay urges us to complement work on the philosophy and social science of race that has focused on the “visual” and “epistemic” dimension of racism with work on affect or what is here called the somatological dimensions of racism. The racist self hears race before he sees it. The racist self is convulsed by race before she experiences it as an epistemic affair. It is argued here that we dwell in the sound house of race. Before racism is chromocratic, (...) it is phonocratic. The technologies of the racist self are the technologies of racializing aurality and phonology. Racism brands us sonically. Race, it will be argued, is a sonic stigmata. More specifically, the focus will be on voice, accent, what here is called the prosody of race. The aim is make those racialized and racializing accents in philosophy resound, echo, and reverberate so that we can hear the prosody of race. The racist does not dwell in the silent chamber of the mind’s “I.” The viscera of racism dwells in the body our racist habits have domesticated. (shrink)

In the five-year period 2005-2009, Brazil dramatically reduced carbon emissions by about twenty-five percent and at the same time maintained a stable economic growth rate of 3.5% annually. This combination of economic growth and emissions reduction is unique in the world. It was driven by a dramatic reduction in deforestation in the Amazonian forest and the Cerrado Savannah. This shift empowered the sustainability social forces in Brazil to the point that in December 2009 Congress passed a very progressive law internalizing (...) carbon constraints and promoting the transition to a low-carbon economy. The Article first analyzes the Brazilian position in the global carbon cycle and public policies since 2005, including the progressive shift in 2009 and the contradictory dynamic in 2010-2012. It then analyzes the potential for a transition to a low-carbon economy in Brazil and the impact on global climate governance. (shrink)

ABSTRACT This is a brief introduction to a special section on the work of Achille Mbembe.

The social capital literature has focused on the functional and structural properties of social relations, partially neglecting the way in which they are experienced by individuals. Drawing on anthropological and social theory, this article distinguishes two ideal-typical forms of social capital — reciprocity and trust — based on the meaning of the social relations that embed them. Reciprocity is the type of social capital embedded within personal relations, triply defined in the factual, social and temporal dimensions by co-presence, reciprocity and (...) memory, respectively. Trust is the type of social capital embedded within relations with strangers, defined by the condition of impersonality or anonymity. These two types of social capital cannot be reduced to extremes in a continuum, nor are they fungible, and while reciprocity is by definition particularistic (this is the source of its strength as a linking mechanism), trust has a universalistic potential. Analytical and empirical implications of this distinction are outlined. (shrink)

En efecto, no sólo el libro y sus páginas, sino asimismo los personajes y cada elemento puesto en escena se articulan en el desarrollo del relato y (...) allí pierden su apariencia de objetos para revelarse como funciones en la producción del sentido final. Las «metáforas», «analogías» o «alegorías» tienen un lugar bien ganado en la tradición filosófica. Han sido atacadas por dar lugar a una interpretación poco rigurosa de las nociones que describen, pues permite asociarles propiedades que originalmente no se había pensado (ni resulta deseable) que formen parte de su concepto. Sin embargo, a pesar del reclamo en favor de procedimientos estrictos de definición, el uso de una imagen apropiada suele ser el mejor modo de explicar esas cuestiones que cada siglo escapan (...) a la disección que el filo de las mejores definiciones pretendía darle. Tal es el caso de las ilustraciones usadas por Charles S. Peirce en sus artículos "Algunas consecuencias de cuatro incapacidades" y "Cómo esclarecer nuestras ideas" para dar cuenta del pensamiento. Primero veremos el papel que juegan estas imágenes en la argumentación conque Peirce establece dos principios importantes de su filosofía: el de que toda cognición se encuentra determinada por otras cogniciones previas, y el de que no tenemos ningún poder de introspección. Luego hallaremos que dos de las imágenes presentan cierta incompatibilidad en un aspecto especialmente relevante desde el punto de vista de lo que tratan de ilustrar. Para finalizar, consideraremos una explicación que sea consistente con los textos y que permita resolver la discrepancia, brindando una mejor comprensión conjunta de ambas ilustraciones . (shrink)

Esta sección temática constituye la segunda discusión sobre el desafío de la adopción de reglas lógicas publicado en Análisis Filosófico. Al igual que la primera, esta colección de artículos puede verse como el resultado de la colaboración internacional que durante más de dos décadas hemos mantenido entre el Saul Kripke Center (SKC) y el IIF-SADAF-CONICET. Y más precisamente, entre Saul, Romina y el grupo de lógica de Buenos Aires (BA-Logic). Visitas, seminarios, workshops, proyectos internacionales, y fundamentalmente mucho afecto y pasión (...) por los problemas filosóficos fundamentales han marcado este proceso. Tanto Romina como Saul han apoyado sistemáticamente los esfuerzos desde Argentina para producir conocimiento en el área de lógica. Ambos han estado involucrados no solo institucionalmente en el apoyo al desarrollo de nuestro grupo, sino también a nivel personal. Fueron muchos los momentos que compartimos juntos. Muchos recuerdos e historias. Es importante destacar, solo para mencionar un simple aspecto de nuestras historias comunes, que Saul participó activamente en el proceso de elaboración de la propuesta de ambos números, en la lectura de gran parte del material, e incluso como réferi de algunos trabajos. Saul y Romina asistieron por Zoom a varias reuniones en el marco de los seminarios que generaron parte del material aquí publicado. Recuerdo la alegría de Saul, sus comentarios y la sorpresa de muchos de los participantes de ver aparecer en sus pantallas al filósofo más importante del mundo y uno de los más importantes de la historia. Para ellos quizás era Kripke, para mi ya era Saul. Nos hubiera gustado celebrar juntos. Podría haber sido en Buenos Aires o en Nueva York. Lamentablemente, ya no podrá ser. Aunque también es cierto que esta sección temática es una manera de volver a reunirnos y de expresar el profundo agradecimiento que todos los integrantes del BA-Logic tenemos por Saul. In this paper I criticize Comesaña's point of view on Putnam's model-theoretic argument. I claim that there is an interesting point made by the argument that Comesaña has not taken into account: if we want our semantic assertions to be at ali justified, the externalist claim according to which justification requires the God 's Eye View has to be given up.

Los últimos avances de la ciencia invitan a pensar en la posibilidad práctica del transhumanismo. Pero quizá es pertinente estudiar una pregunta a la que todavía ni la ciencia ni la filosofía han sabido dar respuesta. En concreto, la naturaleza de la consciencia fenoménica de Ned Block o del concepto de vigilancia de Stanislas Dehaene. Pese a los últimos avances en neurociencia y en inteligencia artificial, seguimos sin pistas para responder a la pregunta del problema fuerte de la consciencia de (...) David Chalmers, del como y por qué estamos aquí. Somos capaces de discriminar de que información somos conscientes, pero no hemos conseguido averiguar por qué somos conscientes o como se genera esa consciencia. El problema es mas grave de lo que parece, ya que no somos capaces de medir, definir ni replicar la consciencia fenoménica. Sin medición, si el objeto de estudio es subjetivo y cualitativo, no se puede aplicar el método científico. Luego, pese a que podríamos replicar la información de nuestro cerebro en un artefacto mecánico, nada garantiza que nuestra consciencia fenoménica se replique ahí, ya que no podemos medir la consciencia fenoménica. Este artefacto hecho a imitación nuestra podría no ser mas que un zombie filosófico, en palabras de David Chalmers, un ser sin consciencia fenoménica, un ser sin alma. Ante esta realidad, cabe preguntarnos: ¿es seguro explorar la alternativa de trascender en un sistema independiente de nuestro cerebro biológico, como un ordenador, sino tenemos ninguna herramienta para medir si ese sistema puede ser consciente de si mismo o producir consciencia fenoménica como un epifenómeno? Si la respuesta, como se defiende en este trabajo, es negativa, una alternativa mas segura para el transhumanismo es explorar la ingeniería genética, los implantes artificiales o embeber el cerebro en sistemas artificiales. This paper raises the question under what circumstances a plurality forms a set. My main point is that not always all things form sets. A provocative way of presenting my position is that, as a result of my approach, there are more pluralities than sets. Another way of presenting the same thesis claims that there are ways of talking about objects that do not always collapse into sets. My argument is related to expressive powers of formal languages. Assuming classical logic, (...) I show that if all plurality form a set and the quantifiers are absolutely general, then one gets a trivial theory. So, by reductio, one has to abandon one of the premiss. Then, I argue against the collapse of the pluralities into sets. What I am advocating is that the thesis of collapse limits important applications of the plural logic in model theory, when it is assumed that the quantifiers are absolutely general. (shrink)

Este texto construye una versión de la teoría de Hegel acerca de la sanción penal, principalmente a partir de su Fundamentos de la Filosofía del Derecho, como una teoría agnóstica da la pena. El texto demuestra como la contradicción interna presentada por Hegel en cuanto el filósofo intenta resolver los problemas acerca de la punición no son resueltas, pero, por el contrario, como esas contradicciones necesariamente se integran a todo posible concepto o imposición de la sanción criminal.

This article analyses different ways of perceiving sports based on the study of cinematographic documentary of the first Olympic Games. The aim is to explore the political discourses and aesthetic senses transmitted through images, studying footages from the beginning of the twentieth century until Berlin 1936, when the aestheticization process became analogous to the sportization process, as Norbert Elias pointed out. This ‘movement-image’—as Gilles Deleuze named it—shows that a set of documentary Olympics footages, especially those produced since Saint Louis Games (...) in 1904, projected meanings about the individual and collective body. The hypothesis is that historic filmed physical activities intended to educate through not only the gaze but also the gaze itself, to form ways of perceiving bodies and practices.The central focus of this paper argues that the informative cinema teaches through the exhibition of educated bodies, but also forms the sensitivity of the viewer perspective. In other words, it not only transmits ways of doing but also forms an ethos, to form ways of perceiving, to form ways of being sensitive. The aim of this study is to explore the political discourses and aesthetic senses transmitted through the Olympic images, which are often loaded with moralism and patriotism. This paper concludes with a conceptual counterpoint between Jacques Rancière and Walter Benjamin about technical reproducibility and political reproduction, considering the aesthetic-political tension that sports put into play. This paper addresses the reception of Hegel’s philosophy in Argentina from an exploratory point of view. For this, it offers a preliminary state of the art in which the sources and materials for a study of this type are determined, and a periodization of the reception is proposed that includes the following periods: 1) from the 19th century to the Argentine University Reform of 1918, the time of Hegel’s indirect presence; 2) from 1918 to the First National Congress of Philosophy (...) in 1949, the true beginning of the reception of Hegel; 3) from 1949 to 1982/83, a period of dispute between the existentialist, Marxist, theological and Peronist interpretations of Hegel; and 4) from the democratic restoration to the present, when an institutional consolidation of Hegelian Studies is perceived in the country. As first conclusions, the federal character of the reception of Hegel’s philosophy and the two main moments of the institutionalization of Hegelian Studies in 1931 and 1983 stand out. The first one, in the context of the anti-positivist reaction and the vindication of German philosophy, and the second one, in the framework of the stabilization of academic activity due to the democratic transition. En el presente artículo se localizan los primeros indicios del surgimiento de la subjetividad viviente en la Filosofía de la Naturaleza de Hegel, especialmente en la primera forma de la naturaleza orgánica: el organismo geológico. Se sostiene que en el abordaje hegeliano del mar, en tanto “Tierra neutral”, puede encontrarse el surgimiento de una subjetividad viviente que, debido a su condición rudimentaria, no logra constituirse aún como un ser independiente.

The global economy’s centre of gravity is shifting. Emerging and developing countries have been contributing over 50% of the global GDP since the onset of the 21st century, which is unprecedented since the Industrial Revolution. This article offers the first analysis of the creeping convergence of the BRIC world (ie Brazil, Russia, India and China) with global legal standards in a key area of International Law: the International Tax Regime (ITR). The ITR is a legal technology fundamentally designed by the (...) League of Nations in the 1920s, when the BRICs played no relevant role. This article proposes a theory that aims to illuminate the core driving forces of the on-going trend towards global convergence in this area of International Law from both the static and dynamic dimensions.
